Energy Wire Contractor Terms Of Service
Energy Wire ("We", "Us"" or Energy Wire) is owned and operated by J. Holt & Associates. We provide and maintain an Internet Web site (the "Site") for the benefit of users of our services ("contractor", "You" or "User"). Energy Wire reserves the right to change or modify any of the terms and conditions contained in this Agreement at any time and from time to time in its sole discretion, and to determine whether any such changes apply to both existing or future. Energy Wire may make changes or modifications to referenced policies or guidelines without notice to you. Your continued use of the Services following Energy Wire's posting of any changes or modifications will constitute your acceptance of such changes or modifications. 1. ACKNOWLEDGMENT AND ACCEPTANCE. FURTHERMORE, BY REGISTERING WITH OUR ENERGY WIRE SERVICES YOU AGREE TO ADHERE TO THE FOLLOWING STANDARDS AND PRINCIPLES: * Your company has been in business in your
area for at least one year. You shall pay Energy Wire for the Services in accordance with the Agreement. Federal, state and local taxes are all included in our rates. A $15 collection fee will be charged for all dishonored checks. A $15 fee will be assessed for the following reasons: payment with insufficient funds, denied or invalid credit card number. You understand that fees paid for the Services are nonrefundable. 3. DISCLAIMER. Energy Wire cannot and does not control whether or
not prospective customers will complete the process of hiring a provider for the services they
are seeking. In the event a Contractor has a
dispute with one or more prospective customers, the Contractor releases Energy Wire and its
agents and employees from claims, demands, and damages arising out of or in any
way connected with that dispute. Energy Wire is not involved in any actual
transactions between Contractor and prospective customers. As a result, Energy Wire has no
control over the ability of prospective customers to purchase services or qualify for financing
or any other form of credit. Energy Wire cannot and does not guarantee that
each prospective customer is whom they claim to be. In addition, Energy Wire does not guarantee
the number of prospective customers you will receive using our service. 5. NATURE OF AGREEMENT. 6. COPYRIGHT. 7. USE OF THE ENERGY WIRE SEAL OF APPROVAL. The Energy Wire Seal Of Approval may only be used by quality approved members. The format of the Energy Wire Seal Of Approval may not be changed. Approved members may reproduce the Energy Wire Seal Of Approval for use in print media such as newspaper advertisements, telephone directory advertisements, stationery, business cards, fliers, brochures and newsletters. In addition approved members may place the Energy Wire Seal Of Approval on their company website. 8. GOVERNING LAW. This Agreement is entered into in the State of Oregon and it shall be interpreted, construed and governed by the laws of the State of Oregon, without reference to its laws relating to conflicts of law. Venue for all disputes arising under this Agreement or resulting from a Site visitor's access or use of the Site shall lie exclusively in the courts located in Washington County, Oregon, and you hereby consent to the personal jurisdiction of such courts.
